These Terms are written for Our Story Continues. Before launching, have a licensed attorney review this page for your state, payment flow, subscription terms, and data practices.

1. Agreement to These Terms

These Terms & Conditions (“Terms”) govern your access to and use of Our Story Continues, including our website, memory collection tools, account features, subscription plans, collaboration tools, digital storage features, guided prompts, and any related services we provide (collectively, the “Service”). “Our Story Continues,” “we,” “us,” and “our” refer to Our Story Continues. By creating an account, purchasing a plan, inviting contributors, uploading content, or using the Service, you agree to these Terms and our Privacy Policy.

2. Who May Use the Service

You must be at least 18 years old and able to enter into a binding agreement to create an account or purchase a plan. You may not create an account on behalf of a child. If you upload memories, photos, videos, audio, or written reflections involving minors, you represent that you are the parent, legal guardian, or otherwise have the right and permission to share that content through the Service.

3. What the Service Does

Our Story Continues helps users create private or shared Memory Collections that may include photos, videos, voice recordings, written reflections, guided prompts, contributor submissions, and related keepsake materials. Some features may be free, and others may require a paid subscription or separate purchase.

4. Accounts, Passwords, and Access

You are responsible for keeping your login information, passwords, passcodes, and account access secure. You are responsible for activity that occurs under your account, including activity by people you invite to a Memory Collection. Contact us immediately if you believe your account has been accessed without permission.

5. Subscriptions, Billing, Taxes, and Cancellations

Paid plans may be billed on a recurring basis until canceled. By purchasing a paid plan, you authorize us and our payment processor to charge your payment method for subscription fees, applicable taxes, and any purchases you approve. Prices, features, storage limits, and plan benefits may change, but we will try to provide notice when changes materially affect your plan.

You may cancel your subscription through your account settings or by contacting support. Cancellation stops future billing, but it does not automatically refund past charges unless required by law or expressly stated by us. Physical keepsakes, printed products, custom work, or completed digital services may be non-refundable once production or fulfillment begins.

6. User Content and Ownership

“User Content” means anything you or your invited contributors upload, create, submit, record, store, or share through the Service, including photos, videos, audio recordings, written stories, comments, prompts, names, dates, and keepsake details. You keep ownership of your User Content.

To provide the Service, you grant us a limited, non-exclusive, worldwide license to host, store, back up, process, display, transmit, reproduce, format, and otherwise use your User Content only as needed to operate, improve, support, protect, and provide the Service, including creating digital or printed keepsakes you request.

7. Your Responsibilities for Content

You represent and agree that you have all rights, permissions, consents, and authority needed to upload and share your User Content. You are responsible for ensuring that your User Content does not violate another person’s privacy, publicity, intellectual property, confidentiality, or other rights.

You may not upload or share content that is illegal, abusive, exploitative, threatening, defamatory, discriminatory, sexually explicit involving minors, invasive of privacy, infringing, or otherwise harmful. We may remove content, restrict access, suspend accounts, or terminate accounts if we believe these Terms have been violated or if required to protect users, the Service, or the public.

8. Invited Contributors and Shared Collections

If you invite family members, friends, partners, or other contributors, you are responsible for choosing who receives access and for explaining how the Memory Collection will be used. Contributors may be able to view, add, or edit content depending on the permissions available in the Service. Do not invite someone or share their information without permission.

9. Privacy and Sensitive Memories

Memory Collections may include personal, emotional, family, historical, health-related, or sensitive information. You should only upload information you are comfortable storing and sharing with the people you choose. Our Privacy Policy explains how we collect, use, share, and protect information.

10. Third-Party Services

We may use third-party providers for hosting, authentication, storage, payments, email, analytics, customer support, printing, shipping, or other business operations. Third-party services may have their own terms and privacy practices. We are not responsible for third-party websites, platforms, or services that we do not control.

11. Intellectual Property

The Service, website design, text, features, prompts, logos, branding, graphics, software, and other materials we provide are owned by us or our licensors and are protected by intellectual property laws. You may not copy, sell, reverse engineer, or misuse the Service or our branding without written permission.

12. Copyright Complaints

If you believe content on the Service infringes your copyright, contact us at OurStoryContinuesSupport@gmail.com with: your name and contact information, a description of the copyrighted work, the location of the allegedly infringing content, a statement that you have a good-faith belief the use is unauthorized, and a statement that the information you provide is accurate.

13. Service Changes, Availability, and Data Loss

We may update, modify, pause, or discontinue parts of the Service. We work to keep the Service available and secure, but we do not guarantee uninterrupted access, permanent storage, error-free operation, or that content will never be lost. You should keep your own backup copies of important photos, videos, audio, and written memories.

14. Prohibited Uses

You agree not to misuse the Service, including by attempting to access another user’s account, interfering with security, uploading malware, scraping data, using the Service for unlawful purposes, harassing others, impersonating someone, or violating another person’s rights.

15. Disclaimers

The Service is provided “as is” and “as available.” To the fullest extent allowed by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and security. Guided prompts and memory tools are provided for reflection and organization only and are not legal, medical, financial, mental health, genealogical, or professional advice.

16. Limitation of Liability

To the fullest extent allowed by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, emotional distress, business interruption, or unauthorized access resulting from your use of the Service. To the fullest extent allowed by law, our total liability for any claim related to the Service will not exceed the amount you paid us for the Service in the three months before the event giving rise to the claim, or $100 if you have not paid us.

17. Indemnification

You agree to defend, indemnify, and hold harmless Our Story Continues, Our Story Continues, and our owners, employees, contractors, service providers, and partners from claims, damages, losses, liabilities, costs, and expenses arising from your User Content, your use of the Service, your violation of these Terms, or your violation of another person’s rights.

18. Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, create risk, fail to pay, or use the Service in a way that may harm us, our users, or others. After termination or cancellation, access to content may be limited or deleted according to our retention practices and Privacy Policy.

19. Governing Law and Disputes

These Terms are governed by the laws of the laws of the state where Our Story Continues is legally registered or principally operates, without regard to conflict of law rules, unless another law requires otherwise. Any dispute will be handled in a court with proper jurisdiction unless the law requires another forum. You and we agree to try to resolve disputes informally first by contacting each other.

20. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new “Last updated” date. If changes are material, we may provide additional notice. Continued use of the Service after changes means you accept the updated Terms.
